    Haryana RERA says a fully paid buyer cannot be stopped from transferring a property because the promoter delayed the conveyance deed

    The Haryana Real Estate Regulatory Authority held that a buyer who has paid in full and taken possession cannot be blocked from selling or transferring the property just because the promoter has not executed the conveyance deed. The promoter, Apex Build-well, was ordered to pay 11 percent interest on the Rs 27 lakh paid for a commercial shop in Sector 37C, Gurugram, along with compensation and litigation costs.

What these updates change

Does registering a sale deed prove ownership?
No. Registration under the Registration Act, 1908 records that an instrument was executed, not that the seller had title to convey. Ownership comes from the chain of title, the encumbrance record and possession.
Which updates actually change a title search?
Judgments on title, possession and limitation; stamp duty and circle rate revisions; land record and registration procedure changes; and secured lending rules such as SARFAESI enforcement and RBI disclosure circulars.
Central rule or state rule?
Both. The Registration Act, the Transfer of Property Act and RBI circulars apply nationally. Stamp duty, land records and RERA rules are state subjects, so an Andhra Pradesh amendment does not bind Karnataka.

    In an IBC liquidation e-auction, the Supreme Court held that the earnest money and deposited amount are forfeited automatically when a bidder fails to pay the balance in time, because the e-auction notice terms govern even where the liquidation regulations are silent on forfeiture.
