Buyers frequently rely on the seller's own lawyer, or no lawyer at all, to confirm the property is free of disputes, mortgages, and litigation. A title check commissioned by the seller has an obvious incentive problem; an independent check does not.

Fake or unauthorised owners and POA misuse

Property sold under a Power of Attorney (POA) is a recurring source of online fraud: the POA may be forged, expired, revoked, or never actually authorised for sale. Buyers who never speak directly to the registered owner carry this risk in full.

  2. Verify title and Encumbrance Certificate before any payment. Request the registered sale deed, trace the chain of ownership, and pull the Encumbrance Certificate from the state registration department to confirm there's no active mortgage, lien, or prior unresolved sale.   3. Check regulatory approvals. For under-construction property, confirm the project's RERA registration number on your state's RERA portal (for example, MahaRERA for Maharashtra projects) and match the promised delivery date and sanctioned plan against what's advertised. For ready-to-move property, confirm the Occupancy Certificate (OC) and Completion Certificate (CC) exist; a flat without an OC can create problems getting utility connections and loans later.
  4. Get an independent legal opinion or property rating. A third-party assessment (not commissioned by the seller) is the single highest-impact step in the entire process, because it's the one point where an interested party isn't grading their own homework.
  5. Negotiate and pay a token only after verification, backed by a proper agreement. Once title and approvals check out, document a token or advance in a written agreement to sell, specifying refund conditions if the deal falls through.
